1. Agreement to Terms By accessing or using driftsAi.com ("the Website") and any software products, custom development services, or applications provided by DriftsAI (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you are expressly prohibited from using the Services and must discontinue use immediately. 2. Our Services DriftsAI provides a dual-approach technology service: Ready-Made Software: Premium, off-the-shelf software solutions (such as D-Track Pro and DriftClick) available for license and deployment. Custom Software Development: Bespoke mobile and web application engineering tailored to specific organizational workflows. 3. Intellectual Property Rights Unless otherwise indicated, the Website and all ready-made software products are our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Website (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us. For custom software development, intellectual property rights, source code ownership, and licensing will be governed by the specific separate Master Services Agreement (MSA) signed between DriftsAI and the purchasing client. 4. User Representations and Account Security By using the Services, you represent and warrant that: All registration information you submit will be true, accurate, current, and complete. You will maintain the accuracy of such information and promptly update such registration information as necessary. You are responsible for keeping your password confidential and will be responsible for all use of your account and password. 5. Prohibited Activities You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to: Systematically retrieve data or other content from the Services to create or compile a collection, compilation, database, or directory without written permission from us. Circumvent, disable, or otherwise interfere with security-related features of the Services. Engage in unauthorized framing of or linking to the Services. Attempt to impersonate another user or person or use the username of another user. Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise without a valid license. Reverse engineer, decompile, or disassemble any of our ready-made software products. 6. Local Data Storage & Offline-First Applications Certain products provided by DriftsAI (such as D-Track Pro) may utilize offline-first architecture, meaning your business data is stored locally on your device's browser or local storage. You acknowledge and agree that DriftsAI is not responsible for the loss of any data resulting from you clearing your browser cache, uninstalling the application, or failing to utilize the provided "Export Backup" features. 7. Purchases and Payment We accept various forms of payment for our software licenses and custom development retainers. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Website. Prices are subject to change. For custom development, payment milestones will be strictly defined in your project proposal. 8. Limitation of Liability In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Services, even if we have been advised of the possibility of such damages. All ready-made software is provided on an "as-is" and "as-available" basis. 9. Governing Law These Terms shall be governed by and defined following the laws of India. DriftsAI and yourself irrevocably consent that the courts of India shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms. 10.
